Improvement of the PPP Legal and Institutional Framework in Haiti

EKWA performed the following services:

  • Establishment of a legal PPP framework including the drafting of the PPP law and related regulations relating, in particular to the creation of a PPP unit
  • Recommendations regarding the role and responsibilities to the institution in charge of public procurements as well as sectoral and local institutions
  • Identification of existing regulations that shall be amended
  • Recommendations as to the implementation decrees that shall be enacted.
  • Drafting of a PPP law and related regulations governing the evaluation (technical, financial, legal, environmental and social assessment and feasibility), development, procurement (definition of selection criteria, including the participation of local and regional and implementation of PPP projects, including the establishment of a PPP unit, the procurement procedures (Competitive Dialog and Unsolicited proposals assessment mechanisms) as well as the audit and supervision procedures
  • Determination of the institutional organization for the assessment, development, procurement, implementation and monitoring of PPP projects
  • Presentation of the proposed PPP legal framework to the Public Financial Commission of the National Assembly and of the Senate as well as main public and private stakeholders
  • Definition of PPP training sessions for the public as well as the private sector
  • Drafting of the legal, institutional and regulatory aspects of the Manual of Procedures for the promotion, evaluation, procurement, implementation, supervision and audit of PPP projects.
